Two friends/colleagues of mine are in trouble with the law in the US- I think you are aware of the voteauction.com action (for lack of a better term). Liz Haas aka lizvlx and Hans from Ubermorgen.com are looking at numerous lawsuits in the US after taking on the site from James Baumgartner. To make a long story short - they were contacted by mutual friends and asked to take over the project when things got too heavy for Baumgartner, the logic being that they would be less vulnerable as Europeans. They are now seeking the support of EFF and ACLU, as they are not as invulnerable as one might have thought. This might be difficult enough, but to make things more difficult and I really hate to bother you with this, but it has become relevant, Hans has a rather difficult relationship with the some of the etoy group, which he co-founded. It is clear that one member of etoy is writing to EFF and requesting that EFF not support voteauction.com for various reasons. I won't go into all the details here, but on at least two points, the accusations are simply false - one being that Ubermorgen has taken on voteauction.com as a marketing gimmick for the company, and that etoy will use any support the EFF provides voteauction.com as a reason to turn the etoy campaign group against EFF. I think what makes these accusations especially false is that Ubermorgen was asked to take on voteauction.com by one of the people behind the work of the etoys war (from Rt.mark) who is not an etoy. Many of the people who supported the etoys war also support voteauction.com and are not simply a mass to be called on a personal whim. I include myself here, as I search for some legal support for voteauction .com in the states. Finally, I know that Liz and Hans have been in contact with Brad Templeton at EFF who was quite frank about receiving mail from one of the etoy members (Zai), and the questions that were raised by him. This does seem to have cooled down his interest in supporting voteauction.com. Could you possibly look into the matter? I'm not sure what else can be done but I'd hate to see voteauction.com or these two people (that I have a great deal of respect for) suffer because of unresolved personal matters. In Ansprüchen aus Vertragsrecht hingegen ist der Gerichtsstand Deutschland, Düsseldorf. Ob Ihr in vertraglicher Hinsicht vor Gericht Erfolg haben könnt, hängt von der entscheidenden Frage ab, ob die "Terms and Conditions" von JOKER bzw. CSL in dem Punkt wirksam geworden sind, in dem sie gemäß dem miteinbezogenen "Registration Agreement" (Punkt 4) ein Abschaltrecht des Access-Providers - sei es für CORE, sei es auch für JOKER - regeln. Eine solche Vereinbarung ist nur dann wirksam, wenn der Verwender - Verwender ist JOKER als Vertragsschließender, CORE ist lediglich Erfüllungsgehilfe - rechtlich verpflichtet ist, eine WEbsite wegen ihres Inhaltes abzuschalten. Eine solche Verpflichtung besteht für JOKER nicht, da die Website nicht strafbar ist nach deutschem Recht (da kein nationales Rechtsgut betroffen ist) und somit keine rechtswidrigen Inhalte enthält. Daß CORE möglicherweise nach Schweizer Recht verpflichtet sein mag, die Website abzuschalten, mag dahingestellt bleiben. Damit verstößt der miteinbezogene Punkt 4 des "Registration Agreement" gegen § 9 AGBG und ist unwirksam. Der weitere Weg führt im Ergebnis zu einem Schadensersatzanspruch gegen JOKER aus nächträglicher, vom Schuldner zu vertretender Unmöglichkeit nach § 325 BGB. Problem ist hier nicht die Vollstreckung, da Ihr LEDIGLICH SCHADENSERSATZ IN GELD zugesprochen bekommt, nicht aber eine Verpflichtung gegen CORE, die Website wieder ins Netz zu stellen. Einen Anspruch gegen CORE auf Freigabe der Domain habt Ihr grundsätzlich nach § 97 UrhG, da CORE mit seiner Maßnahme in Euer Veröffentlichungsrecht als Urheber eines Kunstwerks eingegriffen hat. In materieller Hinsicht ist fraglich, ob CORE gerechtfertigt gewesen ist, wenn nach Schweizer Recht eine Rechtspflicht für CORE bestanden hätte, einzugreifen. Eine solche Rechtfertigung existiert jedoch nicht nach deutschem Recht, sodaß grundsätzlich von einem Anspruch ausgegangen werden darf. Ein Anspruch auf Schadensersatz mit dem Inhalt, daß die Website wieder ins Netz gebracht werden kann, wird jedoch von deutschen Gerichten nicht gewährt: Die deutschen Gerichte sprechen keinen Schadensersatzanspruch für einen weltweit entstandenen Schaden zu, sodaß der Wiedergutmachungsakt, die Seite wieder freizuschalten, bereits hier scheitert, soweit es nicht die Möglichkeit gibt, CORE zu verpflichten, die Seite für deutsche Nutzer allein freizuschalten. Die prozessuale Frage, ob überhaupt ein Gerichtsstand in Deutschland gegeben ist, da grundsätzlich der Gerichtsstand des Handlungsortes ist und somit primär die Schweiz, kann somit dahingestellt bleiben. Ebenfalls nur angesprochen, aber nicht gelöst zu werden braucht hier das Problem, wie ein deutsches Urteil in der Schweiz vollstreckt werden könnte. Beide Rechtsverfolgungen sind übrigens Hauptsache-Klagen und kein Eilrechtsschutz. Wolltet Ihr ein Eilverfahren gegen CORE, so müßtet Ihr eine neue Domain mit dem identischen Inhalt freischalten lassen und anschließend sofort per einstweiliger Verfügung einen Unterlassungsanspruch gegen CORE geltend machen. Gerichtsstand wäre allerdings die Schweiz. Hans Bernhard, James Baumgartner, et al.: Unfortunately, The ACLU lost the bid to keep the case in Federal Court (which had been going on since December) and the case is now back in Illinois State Court, in the hands of the judge who granted the preliminary injunction in the first place. The ACLU does not feel we have as good of a chance with the State Judge as we would have with the Federal Judge, so they are talking with the Board's lawyers about a settlement that would allow me to put the site back up in some form. We were hoping to file a counter-claim that would help me recoup some of my earlier legal costs, but the ACLU doesn't think that will fly with the state judge, so this possible settlement would (hopefully) keep me out of jail or further lawsuits. Also, the state court moves at a snail's pace so it could be quite a while before the case ever got to trial, and this settlement might be completed in time for me to include it as an appendix to my thesis. This is all preliminary right now, so don't mention it to any friends in the press. Once it is all over, I will write a press release declaring victory, free speech rights upheld, etc. I am looking forward to your comments on my thesis draft.
