actually, there is some new information about the case.

i - one of the makers of voteauction.com - have it here
for you.

it was CORE who deaccctivated our domain.
CORE (corenic.org) is a "meta-registry" located
in switzerland.

our registry, CSL gmbh, germany (joker.com) is
a member of CORE. CSL registers domains via CORE.

CORE received an email (!!!) on wednesday from
some-one (attorney-general or court) in missouri
with an attached "order granting temporary restraining order".
they then deactivated the domain right away.
we received notice of this action 1 day later.
(if you would like to see this doc, pls contact me,
i only received it as well via email, and only
in the form of several .pdfs), i will send it
to you.
CORE is also a named defendant in this missouri lawsuit.
it is a civil lawsuit.

in CORE's registration agreement (remember, my registrar
is CSL, not CORE), they have a paragrph 4, which states
something like "we can decactivate a domain if it
is being used in an unlawful way".

in another paragraph, they claim periods of notice
they have to give in such cases:
.normal period: 30 days notice
.short period: 7 days ntice (don't ask me when which applies)
.no notice: if they receive a properly authenticated order
   from o court of competent jurisdiction"

then, in another paragraph, they state that the
governing law of the contract is the swiss one:
" Any action to enforce this Agreement or any matter relating to
your use of the CORE site shall be brought exclusively in the
courts of Switzerland located in Geneva."

appearantly, they feel that a missouri restraining order
is governed under swiss law (???), and that email
prooves athenticity.

very strange to me.

we have informed them, that we will sue them for
damages e.a. if they do not re-activate the domain
until monday 12:00, cet.

this just to clear things up a bit.

last note: we never received proper notice of ANY court
hearings, dates, or other notice of the law suit.
the proper way would be the notification via the
ministrties of external affairs from both countries
(bilateral agreement between .at and .us)
all they did was give us a phone call to a mobile
phone, and that was tuesday night. the order
was issued on wednesday. very funny.

Hi, Andy.

The jurisdiction would presumably be based on the traditional "minimum 
contacts" analysis for personal jurisdiction.  It may help to look at some of 
the documents filed in the case, which are available at:

I find the claims for jurisdiction dubious at best.  The Complaint and 
Memorandum of Law contain a shocking amount of speculation about facts, but 
suffer from substantiation of facts.  Also, the ACLU is now in the case, and 
I believe it has been removed to federal court.

The memories of my family outings are still a source of strength to me. I
remember we'd all pile into the car - I forget what kind it was - and drive 
and
drive. I'm not sure where we'd go, but I think there were some trees there. 
The
smell of something was strong in the air as we played whatever sport we 
played.
